Terms of Sale

1. Seller

2. Scope

These Terms of Sale ("ToS") govern the contractual relationship between the seller and any customer subscribing to a paid plan of FreeMCHost.

3. Plans and pricing

Current plans and rates are presented on the Pricing page. Prices are indicated in euros. VAT is not applicable (article 293 B of the French CGI).

4. Order and payment

The order is placed online from the client area. Payment is processed by Stripe and is due at the time of order.

5. Service activation and immediate delivery

The server is provisioned automatically within seconds of payment confirmation. The customer expressly requests the immediate performance of the service and acknowledges that delivery is complete as soon as the server is created and its credentials are available in the client area.

6. Duration and renewal

Subscriptions are concluded for the period selected at checkout and tacitly renewed at expiration. The customer may cancel at any time from their client area; cancellation takes effect at the end of the current period. No pro-rata refund is granted for a period already started.

7. Right of withdrawal and refunds

No refund can be issued, under any circumstances. Because the service is a digital service delivered instantly at the customer's express request, the right of withdrawal does not apply, in accordance with article L221-28 of the French Consumer Code. This includes, without limitation: unused time, change of mind, plan changes, downgrades, early cancellation, server deletion by the customer, suspension resulting from a breach of the Terms of Service, or dissatisfaction with third-party plugins, mods or game versions.

Wallet credit, promotional credit and referral rewards have no cash value and can never be converted into money or transferred.

8. Chargebacks and abuse

Any chargeback or payment dispute filed without prior contact with support is considered abusive. It results in the immediate suspension and deletion of all the customer's servers and the permanent closure of the account, without compensation. Outstanding amounts remain due.

9. Free plans

Free plans are provided without any commitment, availability guarantee or service level. Free servers depend on a queue, must be renewed periodically (renewal windows of 48 hours, 7 days or 14 days depending on the plan and active bonuses) and may be stopped, suspended or permanently deleted at any time, in particular in the event of non-renewal, inactivity, node maintenance, incident or abuse. No refund, compensation or data recovery can be claimed for a free server.

10. "Skip the Queue" pass and dynamic pricing

For certain free plans subject to a waiting queue, the seller may offer an optional, one-time "Skip the Queue" pass. This pass allows the customer to obtain a server immediately, without joining the queue, even when no stock is displayed as available.

The price of the pass is dynamic: it is calculated in real time at the moment of purchase based on current demand (queue length, estimated waiting time, duration of stock shortage and odds of obtaining a server via the free queue), within a range of €0.55 to €0.99. The price displayed in the purchase dialog is indicative; the exact price is locked in and shown on the Stripe checkout page before payment confirmation. The customer acknowledges and accepts this pricing mechanism.

The pass is a one-time, non-recurring payment. It grants immediate provisioning of one server on the plan concerned; it does not modify the conditions of the free plan itself (renewal obligations, possible deletion, absence of availability guarantee) nor does it guarantee any service level. The resulting server remains a free server subject to section 9. In accordance with section 7 and article L221-28 of the French Consumer Code, the pass is non-refundable under any circumstances, including in the event of subsequent deletion, suspension or non-renewal of the server.

The seller reserves the right to enable, disable or suspend the pass at any time, globally or per plan, without compensation. A purchase already confirmed is always honored.

11. Fair use and prohibited content

Resources (CPU, RAM, disk, network) are provided for standard game-server use. Cryptocurrency mining, proxies, DDoS activity, stress testing, mass file storage, illegal content and any use degrading the shared infrastructure are prohibited and lead to immediate termination without refund, as detailed in the Terms of Service.

12. Availability and maintenance

The seller commits to reasonable efforts to keep the service available but does not guarantee uninterrupted operation. Scheduled maintenance, hardware failures and incidents affecting upstream providers may cause downtime. Compensation, when granted, takes the form of extra service time at the seller's sole discretion, never a monetary refund.

13. Data and backups

FreeMCHost cannot be held responsible for the loss or corruption of data. The customer undertakes to perform regular backups of their server data and to download them before any cancellation, downgrade or expiry.

14. Limitation of liability

The seller's liability is limited to the amount paid by the customer over the last 12 months. The seller cannot be held responsible for damages caused by misuse, third-party plugins, or force majeure events.

15. Hosting infrastructure

The platform is hosted by Lovable. Underlying infrastructure is provided by external providers including, but not limited to: OVH SAS, Oracle Cloud, Contabo, and other partners.

16. Support and claims

Any claim must be submitted through the support ticket system in the client area or by email at hello@freemchost.com. In accordance with French consumer law, the customer may also resort to a consumer mediator; details are available on request.

17. Governing law

These ToS are governed by French law. Any dispute falls under the jurisdiction of the competent French courts.
